1. Agreement to Terms

By accessing or using WallOfLove ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

WallOfLove is operated by WallOfLove ("we," "us," or "our"), a South African company subject to South African law.

2. Description of Service

WallOfLove provides a platform for collecting, managing, and displaying customer testimonials and reviews. The Service includes:

• Testimonial collection forms
• Management dashboard
• Embeddable widgets for websites
• Analytics and reporting
• Integration capabilities

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use WallOfLove. By registering, you represent that you meet these requirements.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

3.3 Account Types

We may offer different account tiers (Free, Pro, Enterprise) with varying features and limitations. Your rights and access depend on your subscription level.

4. User Content and Conduct

4.1 Your Content

You retain ownership of all testimonials and content you submit to WallOfLove. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and display your content
• Make your content available through our widgets and embeds
• Use aggregated, anonymized data for analytics and improvements

4.2 Content Guidelines

You agree NOT to submit content that:

• Is false, misleading, or fraudulent
• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code
• Is defamatory, harassing, or threatening
• Contains explicit, obscene, or offensive material
• Violates the privacy of others
• Promotes illegal activities

4.3 Authenticity

You represent that all testimonials collected through WallOfLove are genuine and from real customers. Fake or fabricated testimonials are strictly prohibited and may result in account termination.

5. Prohibited Activities

You agree NOT to:

• Reverse engineer or attempt to extract source code
• Use automated tools to scrape or harvest data
• Interfere with or disrupt the Service
• Bypass security measures or access restrictions
• Impersonate others or misrepresent your affiliation
• Resell or redistribute the Service without permission
• Use the Service for competitive analysis
• Violate any applicable laws or regulations

6. Payment and Billing

6.1 Pricing

Current pricing is available on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing customers.

6.2 Subscription Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is due on the subscription start date and each renewal
• All fees are non-refundable unless required by law
• Failed payments may result in service suspension

6.3 Taxes

Prices exclude applicable taxes (VAT in South Africa). You are responsible for all taxes associated with your purchase.

6.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access until then, but no refund will be provided for unused time.

7. Intellectual Property

7.1 Our IP

WallOfLove, our logo, and all related marks are our property. The Service and all underlying technology are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes, subject to these Terms.

8. Service Availability

8.1 Uptime

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. Scheduled maintenance will be announced in advance when possible.

8.2 Modifications

We reserve the right to:

• Modify or discontinue features
• Update the Service without notice
• Change system requirements
• Impose usage limits

9. Termination

9.1 By You

You may terminate your account at any time through your account settings or by contacting support.

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay fees when due
• Pose a security risk
• Use the Service illegally

9.3 Effect of Termination

Upon termination, your access will cease immediately. We may retain your data for a reasonable period (30 days) to allow export, after which it may be permanently deleted.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness
• Uninterrupted or error-free operation

You use the Service at your own risk. We do not guarantee specific results or outcomes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALLOFLOVE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Third-party conduct or content
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or R1,000, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless WallOfLove, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of South Africa, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes shall be resolved through:

1. Good faith negotiation
2. Mediation (if negotiation fails)
3. Arbitration or South African courts (as a last resort)

13.3 Jurisdiction

You consent to the exclusive jurisdiction of the courts of South Africa for any legal proceedings.

14. General Provisions

These Terms, along with our Privacy Policy, constitute the entire agreement between you and WallOfLove.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

Our failure to enforce any right does not waive that right.

You may not assign these Terms without our consent. We may assign our rights and obligations at any time.

14.5 Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, pandemics, strikes).

We may update these Terms from time to time. Material changes will be communicated via email or platform notice at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
